By accessing or using FunTastic, you agree to these Terms. If you do not agree with any part of the Terms, you may not access or use the Service. These Terms apply to all users, visitors, and others who interact with the Service.

ACCOUNT REGISTRATION & SECURITY

When creating an account, you agree to provide accurate and up-to-date information. You are responsible for keeping your password confidential and for all activities under your account. Report any unauthorized access or misuse of your credentials immediately.

You must not use a username that violates someone else’s rights or that is offensive or inappropriate. Violating these rules can result in account suspension or termination.

SERVICE CONTENT

FunTastic provides access to a variety of content, which includes:

• Openly licensed works, such as those under Creative Commons licenses (e.g., Blender Open Movies), used in full compliance with their respective license terms and attribution requirements. Where required, attribution for Creative Commons or licensed third-party content is provided within the content itself, the app, or on a dedicated credits page.

• Original FunTastic content, including proprietary videos, games, and other media developed by our team, available to users through free and/or subscription-based access;

• Third-party content licensed directly from independent creators or distributors, subject to specific access terms (either free or behind a paywall, as agreed upon with the rights holders).

Content provided via the Service is intended solely for personal, non-commercial, at-home use. Users may stream or download content through the FunTastic app, where permitted. Downloaded content must be accessed only through the official app and may not be redistributed or used outside of the platform.

We reserve the right to update, replace, or remove any content at our sole discretion and without prior notice.

SUBSCRIPTION TERMS

A valid subscription gives you access to all available FunTastic content during its active period.

- Charges are billed to your iTunes Account when you confirm your purchase.

- Unless canceled, your subscription will automatically renew within 24 hours of the current term’s end.

- Renewal charges will be confirmed and processed through your Apple account settings.

- You can disable auto-renewal at any time through your Apple ID settings.

- If you are offered a free trial and do not fully use it, the remaining time will be lost after you purchase a subscription.

LIMITED LIABILITY

ThunderMedia Group., its affiliates, and licensors are not liable for indirect, incidental, or consequential damages. This includes, but is not limited to, loss of profits, data, goodwill, or any intangible loss resulting from your use of or inability to use the Service.

This limitation applies even if we have been informed of the possibility of such damages. We are not responsible for issues arising from content licensed from third parties or accessed through third-party platforms or links.

TERMINATION

We may suspend or terminate your access to the Service at our discretion without prior notice for violating these Terms or any applicable law.

If you want to stop using the Service, simply delete your account or stop using the app. If your access is suspended or terminated and you believe this was in error, please contact us to resolve the issue.

EXTERNAL LINKS

The Service may link to websites or services that ThunderMedia Group does not own. We are not responsible for the content, practices, or privacy of these third-party platforms.

We recommend reviewing their policies before using any third-party service.

INTELLECTUAL PROPERTY

The FunTastic platform, including its design, branding, original content, games, and all features and functionality, is the exclusive property of FunTastic, ThunderMedia Group, and its authorized licensors or partners. All content is protected by copyright, trademark, and other applicable intellectual property laws.

Use of any proprietary content, trademarks, logos, or assets without prior written consent is strictly prohibited. This includes, but is not limited to, reproduction, redistribution, or adaptation of our original material for any commercial or public purpose.

Some content made available on the platform may remain the intellectual property of the original creators and is used under license or agreement.

NO GUARANTEES

The Service is provided “as is” without any guarantees. We do not promise:

- Continuous, uninterrupted access

- Fixing of defects

- That the Service is virus-free

- That your experience will meet expectations

Use the Service at your own risk.

GOVERNING LAW

These Terms are governed by the laws of Brazil. Any disputes will be resolved according to Brazilian courts.

Failure to enforce any part of these Terms does not mean we waive our rights. If any part is found invalid, the rest will remain in effect.
